Flanagan & Bodenheimer Files Wrongful Death Lawsuit Against Florida Sober Living Facility
Flanagan & Bodenheimer recently filed a lawsuit against a Florida sober living facility for negligent actions that ultimately led to the death of one of their residents. The resident and her family placed their trust in the facility, which promised to provide the care, supervision, and guidance needed to safely end her addiction.
As she began her stay at the facility, she experienced the intense emotional and psychological challenges commonly associated with withdrawal from drugs, including paranoia, fear, depression, and severe anxiety. According to the lawsuit, the facility was fully aware of these risks and the resident’s ongoing struggles, yet failed to take appropriate action.
On the day before her death, the resident reached out to a staff member, expressing her deep distress and fear of being kicked out due to her mental health issues. In a series of text messages, she conveyed her panic and the overwhelming sense that her thoughts were out of control. Despite these clear cries for help, the lawsuit states that the facility’s response was inadequate. Instead of providing immediate, in-person care, or contacting medical professionals, the staff member merely suggested that the resident wait until the following day to discuss her mental health issues.
Tragically, this neglect led to the resident being left alone to face her crisis without the necessary support. That night, she relapsed and overdosed on drugs within the facility’s premises.
The lawsuit accuses the sober living facility of multiple forms of negligence, including failing to maintain a drug-free environment, not conducting adequate checks for drugs, and neglecting to provide the necessary mental health care and supervision. The facility is also accused of failing to communicate with the resident’s family and medical providers about her deteriorating condition, as well as not making any effort to transition her to a higher level of care when it became evident that she was in crisis.
